Terms of Use

These Terms of Use ("Terms") govern your access to and use of Physiqly, including the TrainMe mobile app and the web platform (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

You must be at least 16 years old to create an account. By registering, you confirm that you meet this requirement and that the information you provide is accurate.

Physiqly supports two account roles: trainers, who manage their own clients and content, and clients, who may be invited by a trainer or sign up independently for solo self-tracking. You're responsible for keeping your login credentials confidential and for all activity under your account.

Trainer accounts may require a paid subscription to Physiqly. Subscriptions bought inside the iOS app are billed by Apple, those bought inside the Android app by Google Play, and those bought on the web by Paddle. Physiqly is a software tool for trainers to run their coaching business — any pricing or billing arrangement between a trainer and their own clients for coaching services is a separate matter between the trainer and their client, and Physiqly is not a party to it.

Renewal. Subscriptions renew automatically each month until cancelled. You are charged at the start of each billing period.

Cancelling. If you subscribed through the App Store or Google Play, you must cancel in that store's own subscription settings — we cannot cancel it for you, and deleting your Physiqly account does not stop the charge. If you subscribed on the web, you can cancel from the billing page in your dashboard. Cancelling stops future renewals; you keep access until the end of the period you have already paid for.

Refunds. Purchases made through the App Store or Google Play are refunded by Apple or Google under their own policies, and requests must be made to them directly. For web purchases, we refund any charge in full within 14 days of it being taken, including a renewal — email info@physiqly.fit. Changing plans. Moving to a larger plan takes effect immediately and is charged pro rata. Moving to a smaller plan takes effect at your next renewal, so you keep the plan you have already paid for until then.

Physiqly is not a medical service, and nothing in the app constitutes medical advice, diagnosis, or treatment.

Training programs, nutrition targets, and any AI-generated reports or suggestions are provided for general informational and fitness-tracking purposes only. Always consult a physician or qualified healthcare provider before starting any new exercise or nutrition program, especially if you have an existing medical condition, injury, or are pregnant. You are solely responsible for evaluating your own fitness to participate in any activity logged or suggested through the Service.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Impersonate another person, or misrepresent your affiliation with a trainer or client.
• Upload content that is abusive, harassing, hateful, sexually explicit, or otherwise objectionable.
• Attempt to gain unauthorized access to another user's account or data.
• Interfere with or disrupt the Service, including through automated scraping or abuse of rate-limited features.

Community groups let clients post progress updates, comments, and reactions visible to other members of the same trainer-run group. You retain ownership of content you post, but grant us the license needed to store, display, and transmit it within the Service so it can be shown to the intended audience.

You can report content or another member using the in-app report feature. We reserve the right to remove content, and to suspend or terminate accounts, that violate these Terms or that we determine, in our reasonable judgment, to be harmful to the community.

The Service, including its design, features, and underlying software, is owned by Physiqly and protected by applicable intellectual property laws. You retain ownership of the content you upload (such as photos, videos, and posts); we don't claim ownership over it.

You may delete your own account at any time from your account settings — this permanently and immediately deletes your data as described in our Privacy Policy. We may suspend or terminate your access to the Service if you violate these Terms, or for other reasonable business or legal reasons, with notice where practicable.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Physiqly will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any reliance on training, nutrition, or AI-generated content.

We may update these Terms from time to time. If we make material changes, we'll notify you through the app or by email. Continuing to use the Service after changes take effect means you accept the revised Terms.

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Israel.
