Terms of Use

These Terms of Use ("Terms") govern your access to and use of Physiqly, including the Physiqly mobile apps and the web platform (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

You must be at least 16 years old to create an account. By registering, you confirm that you meet this requirement and that the information you provide is accurate.

Physiqly supports two account roles: trainers, who manage their own clients and content, and clients, who may be invited by a trainer or sign up independently for solo self-tracking. You're responsible for keeping your login credentials confidential and for all activity under your account.

Trainer accounts require a paid subscription to Physiqly. Subscriptions are arranged directly with Physiqly and charged through our payment provider, Grow. They are not sold through the App Store, Google Play or any other store, and they are not purchased or changed inside the app. Physiqly is a software tool for trainers to run their coaching business — any pricing or billing arrangement between a trainer and their own clients for coaching services is a separate matter between the trainer and their client, and Physiqly is not a party to it.

The price, the number of clients included and the billing terms of a trainer's subscription are those agreed between the trainer and Physiqly. Questions about a charge, cancelling or a refund: info@physiqly.fit. Clients do not pay Physiqly.

Physiqly is not a medical service, and nothing in the app constitutes medical advice, diagnosis, or treatment.

Training programs, nutrition targets, and any AI-generated reports or suggestions are provided for general informational and fitness-tracking purposes only. Always consult a physician or qualified healthcare provider before starting any new exercise or nutrition program, especially if you have an existing medical condition, injury, or are pregnant. You are solely responsible for evaluating your own fitness to participate in any activity logged or suggested through the Service.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Impersonate another person, or misrepresent your affiliation with a trainer or client.
• Upload content that is abusive, harassing, hateful, sexually explicit, or otherwise objectionable.
• Attempt to gain unauthorized access to another user's account or data.
• Interfere with or disrupt the Service, including through automated scraping or abuse of rate-limited features.

Community groups let clients post progress updates, comments, and reactions visible to other members of the same trainer-run group. You retain ownership of content you post, but grant us the license needed to store, display, and transmit it within the Service so it can be shown to the intended audience.

You can report content or another member using the in-app report feature. We reserve the right to remove content, and to suspend or terminate accounts, that violate these Terms or that we determine, in our reasonable judgment, to be harmful to the community.

The Service, including its design, features, and underlying software, is owned by Physiqly and protected by applicable intellectual property laws. You retain ownership of the content you upload (such as photos, videos, and posts); we don't claim ownership over it.

You may delete your own account at any time from your account settings — this permanently and immediately deletes your data as described in our Privacy Policy. We may suspend or terminate your access to the Service if you violate these Terms, or for other reasonable business or legal reasons, with notice where practicable.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Physiqly will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any reliance on training, nutrition, or AI-generated content.

We may update these Terms from time to time. If we make material changes, we'll notify you through the app or by email. Continuing to use the Service after changes take effect means you accept the revised Terms.

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Israel.
